DELHI, INDIA - BAN

Delhi Degradable Plastic Bag (Manufacture, Sale and Usage) and Garbage (Control) Act, 2000 (Effective November 21, 2008); The law prohibits anyone from manufacturing or selling any plastic bag that is non-biodegrable. Any violators are subject to a jail sentence of up to three years or a fine of twenty five thousand rupee’s, or both. Subsequent violations are treated as separate violations and are subject to the aforementioned penalty’s.

HIMACHAL PRADESH, INDIA - STATEWIDE PLASTIC BAG BAN

The Himachal Pradesh Non-Biodegradable Garbage (Effective as of June 14, 2004); The law imposes a universal ban on all retail establishments from providing single use plastic bags to customers with a material less than 70 microns and 12”x18”. However, the ban does not include prepackaged items that may contain plastic. The penalty fee’s for violating the law would lie in a range of Rs. 500 for up to 100 gms of plastic bags, and up to Rs. 25000 for 10 kg of plastic bags.

KANYAKUMARI, INDIA - BAN

MAHARASHTRA, INDIA - BAN

Maharashtra Act # X of 2006 (Effective as of February 26, 2007); Vendors are prohibited from using carry bags that are thicker than the minimum thickness, which is fifty microns (0.05 millimeters) and of the size of 8x12 inches. Manufacturers are restricted in what type of plastic bags may be produced. Carry bags made of virgin plastic are required to be in a natural shade or white, whereas recycled bags are to be in a range of other colors. Manufactured bags must have displayed on them the amount of recycled content used in producing the bag and the thickness.

INDIA-GENERAL EFFORTS

In India, a law introduced recently prohibits plastic bags thinner than 20 microns in the cities of Bombay and Delhi, along with the entire states of Maharashtra and Kerala. The restriction is meant to discourage production and use due to the thicker bags being more expensive.

KERALA, INDIA - BAN

A ban on all plastic materials, including plastic bags, under 30 microns thick was implemented in September 2007. A fine of Rs5,000 levied if they continue to use plastic bags.

CHANDIGARH, INDIA - BAN

The Environment (Protection) Act 1986 (Effective as of November 2. 2008); The law stipulates that no individual, including shopkeepers, vendors, wholesalers, retailers, traders, hawkers, or rehriwala’s shall use or provide polythene/plastic carry bags in their respective retail establishments. Furthermore, the Act prohibits the manufacturing, storage, importation, sale, or transportation of polythene/plastic bags. The Deputy Commissioner is delegated the authority to ensure enforcement and establish rules and procedures at their discretion to ensure compliance.
